Landlords should keep evidence of why they are withholding deposits, according to mydeposits.co.uk. Deposit protection legislation now allows tenants to formally dispute the amount withheld by their landlord. Consequently, if the property's owner does not have sufficient evidence of the damage in question or the tenant's failure to keep the accommodation in a reasonable condition - protection schemes will often have "no choice but to find in favour of the tenant". David Salusbury, chairman of mydeposits.co.uk, says landlords must take "simple steps" to show any deductions are "justified and proportionate". He advises on the preparation of an agreed inventory with the tenant and suggests that bank statements can be used to highlight non-payment of rent. "Photographic records can also be useful, as can any exchanges of correspondence," he adds. Landlords or letting agencies were allowed to keep the deposits in 11 per cent of the 341 disputes that took place between April 2007 and March 2008, according to statistics from the company.
