14/09/2009 Divorce laws attacked |
|
Britain's divorce laws have been described as "degrading" by a legal expert in the House of Lords.
Baroness Deech is using the first of a series of law lectures to attack the development of the law and the notion that wives should always gain half their husbands' wealth when a marriage ends, the Times reports.
Speaking tomorrow at Gresham College in London, she will state: "The notion that a wife should get half of the joint assets of a couple after even a short, childless marriage has crept up on us without any parliamentary legislation to this effect."
The Baroness, who taught law at Oxford University, argued that the situation accounts for Britain's high divorce rate and said it is based on the outdated assumption that the man is the main breadwinner.
Those looking to safeguard against an unfair settlement after any future divorce may wish to see a family lawyer to get a prenuptial arrangement in place.
Last week, director of the legal practice course (LPC) programmes at the BPP Law School Alison Wells stated that pre-nuptial agreements are on the rise in Britain.
