19/03/2009 Husbands 'using bankruptcy to dodge divorce payments' |
|
Some husbands have sought to avoid divorce settlements by declaring themselves bankrupt, a judge has said.
Lord Justice Wilson raised the issue as he delivered an appeal court ruling on a case where millionaire William Paulin had used the tactic to avoid a £1 million payment to his ex-wife.
Quashing Mr Paulin's appeal against the decision to annul his bankruptcy declaration, the judge said such a method is "occasionally adopted by a devious husband confronted with an application by his wife for financial relief ancillary to divorce proceedings".
Those facing any similar situation could benefit from obtaining legal advice on the matter.
Among those who have suffered negative consequences from a divorce settlement is former footballer Neil Ruddock.
The cost of his split from ex-wife Sarah has left the former West Ham and Liverpool player facing repossession as he has been unable to maintain his mortgage repayments, it has been reported this week.
