30/06/2009 Illegal divorce advice 'given by some sharia courts' |
|
Several of the UK's sharia courts are giving advice that is illegal under British law, according to a new report published by Civitas.
Sharia Law or One Law For All by Denis MacEoin argues that divorce governed by Islamic law is discriminatory against women and suggested that decisions are often made by sharia courts that exceed their legal remit, the Guardian reports.
"Some of these courts are advising illegal actions," Mr MacEoin wrote. "And others transgress human rights standards."
There are thought to be approximately 85 sharia courts in the UK. In 2008, it was ruled by the House of the Lords that the Islamic legal code upheld by these bodies is "wholly incompatible" with human rights laws.
However, there is support for the incorporation of such courts in the country's legal system. The Archbishop of Canterbury Rowan Williams and senior lord of appeal in ordinary Lord Philips both support the move.
People wanting information about the laws governing marriage break up may wish to have a consultation with divorce lawyers.
