28/05/2009 Lords set for divorce case hearing |
|
The House of Lords will hear a divorce case that has already passed through several courts.
Olusola and Sikirat Agbaje, who were born in Nigeria but are British citizens with five UK-born children, divorced in 2005 after 40 years, at which point Mr Agbaje was awarded £616,000, while she gained just £7,000, the Times reports.
Mrs Agbaje has obtained legal aid for the appeal to the highest court in the land over the award, which was made in the west African country, following a sequence of appeals in which she was first awarded £275,000 in the UK before Mr Agbaje successfully overturned the ruling on the basis that the Nigerian judgement should stand.
Those facing divorce whose cases may involve a foreign jurisdiction might wish to seek advice from a solicitor to establish their rights in the matter.
Some may feel a pre-nuptial arrangement is a good way to cover against the possibility that an overseas court could treat one of the parties unfairly.
Such arrangements are becoming more common in the UK, the Ayrshire post reported earlier this month.
