Right to appeal for ex-wife in divorce case
A woman has won the right to appeal against a judge's decision to make her pay £5 million to her ex-husband, whose finances have been hit by the economic downturn.

Elena Bowes Marano and Peter Marano separated in February 2007, with presiding Mrs Justice King splitting their assets equally.

However, the divorce judge later ruled that Ms Marano should pay back £5 million to her ex, after an investment that saw him acquire £88 million of equity in two major London property developments went sour and left him £10 million in the negative.

The test case will likely be being watched closely by divorce lawyers, with the Daily Mail reporting that it "could have far-reaching consequences" for similar major money disputes.

Lord Justice Thorpe - one of the three judges making the decision on whether the appeal could go ahead - said he had "some hesitation" about the matter, but felt "justice requires" the case to be heard.
