A proposed 12-day strike over Christmas by British Airways cabin crew has been prevented on legal grounds.
Members of the Unite union voted overwhelmingly for the action but the airline appealed to the High Court on the grounds that some of those who voted for the action had already left the company.
This claim was upheld, meaning the strike cannot go ahead as scheduled and the union must hold a fresh ballot if it wants to hold a strike - something that can not now take place until the new year.
Unite's joint general secretaries Derek Simpson and Tony Woodley called the move a "disgraceful day for democracy".
However, such a move may indicate that those in dispute with their employers may wish to speak to employment lawyers in London to ensure that any action they take is legally watertight.
Unite's statement concluded by stating that a further ballot will be held unless a negotiated settlement of the dispute can be reached.
