The British Hospitality Association (BHA) has crticised new legislation intended to stop employers 'topping-up' staff wages to meet minimum wage requirements.
According to the BHA, a consultation period is needed to avoid loop holes that could be exploited.
Bob Cotton, chief executive at the BHA, has called for a more considered restructuring of the law so that businesses will have time to adapt to any changes in the law.
He said: "We need a consultation period to work out what it is that the government is going to do, that is going to stand up in the courts."
Mr Cotton explained that he was concerned because the BHA had "reached an agreement with the inland revenue four years ago to have a system of minimum wage and run a tronc system on top".
He explained that the national insurance act and minimum wage act did not support the system which had been agreed on.
The BHA is concerned with what he calls the "anomaly in the law" which he feels cannot be resolved with the proposed "three line clause added to an existing bill" and thinks that a "specific act of parliament" may be required to close the loop hole. |
