03/07/2009 Discrimination law ruling made by House of Lords |
|
The House of Lords has made a ruling on disability discrimination that may impact divorce lawyers in London.
It decided this week that the term disabled can be applied to those with physical or mental conditions if the severity varies over time and it is likely that it will become substantial again in the future.
The ruling came in a case brought by Elizabeth Boyle, who alleged that her former employer SCA Packaging discriminated against her by drawing up plans to remove partitions near to her desk, despite her suffering from vocal nodules that meant she had to speak quietly.
It was argued by the company that Mrs Boyle could not be considered disabled because her condition no longer had an adverse effect on her.
The Equality and Human Rights Commission intervened in the case, saying that people with variable disabilities should have the same rights as those with stable ones.
Last month, the organisation called for a "fresh impetus on delivering disability rights".
