The Equality and Human Rights Commission (EHRC) has issued legal proceedings against three British National Party (BNP) officials after raising concerns that the group could be discriminating against potential members on racial grounds.
Leader Nick Griffin and two others are the subject of the county court action, which stems from the EHRC's claim that the BNP's "membership criteria appear to restrict membership to those within what the BNP regards as particular 'ethnic groups' and those whose skin colour is white".
Exclusion of this kind is in breach of the Race Relations Act, which also applies to employment law.
In June, the EHRC sent the BNP a letter outlining its concerns about the party's membership restriction and criteria.
While the BNP replied saying it will clarify what it means with regards to the use of the word 'white' on its website, the commission stated that it still believes discriminatory practices will persist.
Taking action in cases involving gender, disability and race is among the EHRC's priorities for the 2009-10 business year.
