15/10/2008 Employment Tribunal companies details released |
|
Names and addresses of companies involved in Employment Tribunals must be made public following a new ruling on the matter.
The Information Commissioner's Office (ICO) overturned a decision by the Department for Business Enterprise and Regulatory Reform (BERR) that the details should not be disclosed.
BERR argued under Section 36 (conduct of public affairs) of the Freedom of Information Act, which sets out an exemption from the right to know that the information should not be made public.
Section 36 of the act states that if "in the reasonable opinion of a qualified person" disclosing the information would result in "a specified prejudicial effect", then it should not be released.
The ICO subsequently undertook and investigation the outcome of which was that there was a strong public interest in disclosing the information.
Age Concern's claim that forcing people to stop work at or after 65 without compensation is unjust and breaches EU equality terms was recently rejected by the European Court of Justice.
The decision will affect all those currently claiming compensation on the matter through employment tribunals. |
