There will no longer be a difference between the terms of employment for those on 'ordinary' and 'additional' maternity and adoption leave, Workplace Law Network reports.
The new regulations which remove distinctions between the rights of certain employees came into force yesterday (October 5th) and will affect those who are expected to give birth on or after that date.
Under the Maternity and Parental Leave and the Paternity and Adoption Leave (Amendment) Regulations 2008, both those on Ordinary Maternity Leave (OML) and Additional Maternity Leave (AML) will have the same rights.
In practice this means that any employee taking AML, which is a second 26 weeks of absence, will now be entitled to the same terms as conditions as someone who has taken an initial 26 weeks' leave.
Previously, only employees who had taken OML were entitled to return to the same job they had prior to taking maternity leave.
Countries within the EU may receive an additional four weeks maternity leave following discussions by the European Commission. |
