Prenuptial contracts should now be officially recognised in law, it has been argued.
Writing for the Times, columnist Libby Purves noted the recent case of heiress Katrin Radmacher, whose ex-husband gained a settlement of £5.8 million when a court refused to uphold her pre-nuptial agreement, only for the Appeal Court to overturn this in July.
Ms Purves suggested that such documents could help prevent unfair divorce settlements and suggested this may even help save marriages by underlining the seriousness of the matter.
She quoted one lawyer stating that this would be because people become more practical and less romantic about the whole business.
Those wishing to make a prenuptial agreement may want to speak to family law solicitors.
In June this year a report by chartered accountants Grant Thornton found that the number of such documents is rising.
The study found that 59 per cent of family solicitors deal with the documents more than any other sort of agreement, such as cohabitation or civil partnerships.
