28/09/2009 Legal challenge to retirement law flounders |
|
An attempt to challenge the legal right of employers to oblige workers to retire at 65 has been defeated.
High Court judge Mr Justice Blake ruled that the ability of employers to dismiss workers without redundancy pay at that age was not against European Union law, which Age Concern and Help the Aged had argued.
However, he said he would have ordered a review of the retirement age were it not for the fact that the government is already undertaking one.
Mr Blake said the case for raising the default retirement age from 65 is "compelling" and stated that he cannot see the review leaving the status quo in place.
Those who have an employment issue where they believe their employer has acted wrongly may wish to speak to employment lawyers in London.
The recent launch of a government helpline to provide extra information for those wanting to know their employment rights was welcomed by the chief executive of working practices enhancement body WorkWise UK Phil Flaxton.
The "key" is to put such information to good use to ensure such rights are upheld, he commented.
