Whilst pre-nuptial agreements are not currently legally binding, a financial advice site has suggested that courts are taking the existence of the agreements into account when making judgements in cases. Kevin Morgan, managing director of Consilium Financial Planning Limited, suggested that those getting married should at least consider the benefits of getting a pre-nuptial agreement. Mr Morgan said: "Sadly pre-nups are increasingly an important consideration when entering a marriage or civil partnership contract. It sounds clinical, but cest la vie!" In May, the Guardian reported on the decision by senior judges to allow a woman to keep her £48 million divorce settlement and commented that "wealthy people would be 'mad' to marry without a prenuptial agreement". The Guardian reported that the senior family court judge in the case called for a reform to the current laws on post-divorce disputes over assets. Judge Mark Potter commented: "London has become the divorce capital of the world for aspiring wives." |
