11/09/2009 Pre-nuptial agreements 'on the up' |
|
The level of demand for pre-nuptial agreements in the UK has been increasing in recent years, it has been stated.
Director of the legal practice course programmes at the BPP Law School Alison Wells said the raised levels of divorce had been one factor in the greater frequency of such arrangements.
She added: "Second marriages in particular are therefore often subject to a pre-nup because the parties want to protect their assets for their already acquired children, for example."
Ms Wells predicted that the economic downturn could also lead to more of these as people may be increasingly aware of the value of their assets.
While not legally binding in Britain, courts will "consider the content" of the documents when ruling on a settlement.
Those considering making a pre-nuptial agreement may wish to see a family lawyer about the matter.
The Law Commission is currently carrying out a review of the enforceability of such agreements made before marriages or civil partnerships, with a report due out in 2012.
