A new survey has reportedly found that the Human Rights Act is being used more and more by organisations in commercial lawsuits. The study by Sweet & Maxwell shows that three per cent of cases citing the Act were brought by companies, hedge funds and others businesses in commercial litigation, the Times reports. A further six per cent of cases using human rights arguments were disputes over tax issues with HM Revenue & Customs. Despite the reported increasing prevalence of the Human Rights Act in commercial litigation, the number of cases that use human rights arguments are falling - down 13.7 per cent in 2008 to 327. The newspaper cites the example of hedge funds such as RAB Special Situations and SRM Global Master bringing legal action by claiming that Northern Rock's nationalisation dispossessed them of their assets. Alex Novarese, editor of Legal Week, has claimed that the collapse of Lehman Brothers is "probably going to be the most expensive legal mandate in European legal history".
