30/06/2009 Increased litigation not expected from NHS changes |
|
A rise in litigation law issues is not expected to occur by one expert following planned changes to the NHS.
Michael Sobanja, chief executive of NHS Alliance, said he does not think proposals that would give patients the right to certain types of treatment within a set timeframe would lead to an increase in the number of people looking to sue the health service.
"I don't see this particular announcement giving rise to a greater recourse to legal activity," he remarked.
"You can only sue the NHS for negligence or breach of statutory duties."
Mr Sobanka explained that it is still unclear as to whether patients' entitlement to gain access to cancer specialists within two weeks of referral, for example, will be enshrined into law.
Meanwhile, other proposals, such as the right to receive treatment in no longer than 18 weeks after being referred, are already part of the NHS constitution.
