Corporate names will be regulated so that other firms have the right to complain if something is "sufficiently similar", Workplace Law Network reported. Under Part five of the Companies Act 2006, third parties will be able to question the choice of a company name before a new body. The Company Names Adjudicator is based at the UK Intellectual Property Office (IPO). According to the act, an objection can be made based on the belief that a company's registered name is "the same as a name associated with the applicant in which he has goodwill". Objections can also be made if the name is "sufficiently similar" so that is would be "likely to mislead when used in the UK by "suggesting a connection between the company and the applicant'". The complaint can be related to company names, trading names, brand names and registered trademarks. Workplace Law Networked reported that the Companies Act 2006 was created to "improve and simplify company law". |
