08/02/2010 Woman wins will dispute with charity |
|
A woman has won the right to inherit land owned by her family following the conclusion of a legal dispute with the Royal Society for the Prevention of Cruelty to Animals (RSPCA).
Dr Christine Gill is to claim a £2.3 million farm in North Yorkshire, which she had previously helped to operate with her parents, after being disinherited by their will.
She alleged that the will, which bequeathed the land to the animal charity, had been written against her mother's will under coercion from her "domineering" father.
Despite these concerns over the will writing process, the RSPCA refused calls to enter into mediation or dispute resolution procedures.
It will now be made to pay the majority of the £1.3 million legal bill accrued during the case.
Dr Gill said: "The RSPCA attempted to justify its stance by saying it was obliged under charity law to defend the claim to trial
Today's decision sets the record straight."
Last month, the Fellowship of Professional Willwriters and Probate Practitioners reminded consumers of the need to consult properly qualified experts over will drafting in order to avoid any potential legal complications.
